Man found sleeping in car charged with DWI in Vineland

In New Jersey, a person may be charged with driving while intoxicated based upon allegations that he or she operated a motor vehicle with a blood alcohol concentration of 0.08 percent or more, or if authorities believe that drugs or alcohol negatively impacts a driver’s ability to drive, according the attorney general’s office. Most drivers in the Hackensack area are likely to know that drunk driving is prohibited under New Jersey law. But, each case is dependent upon the individual allegations.

But the case involves details other than the sleeping in a car while intoxicated allegations. Police claim that the man’s SUV was found in the middle of a Vineland, New Jersey, intersection. When officers approached the car, authorities say that the man’s foot was resting on the brake pedal.

What constitutes operating a motor vehicle, which is a necessary aspect of a DWI charge in New Jersey, is generally interpreted fairly broadly by the courts, and a person may face a conviction even if law enforcement did not see the car move. In other words, officials may pursue drunk driving charges based upon allegations that a person was found slumped over the wheel. But, a charge is not a finding of guilt.
