New Jersey man detained after Halloween candy dispute

A Wayne man was taken into custody after he allegedly fought with two neighborhood boys and a man who tried to intervene on Oct. 31. The scuffle reportedly broke out in retaliation for a fight the boys had with the man's son over Halloween candy earlier that night.

Wayne police were called to Oakley Way shortly after 9 p.m. to investigate a fight in progress, and found the 41-year-old man with injuries on his face. Officers claim he appeared to be intoxicated. He reportedly told officers that his son had fought with neighborhood boys over candy earlier in the evening, and that he had come to the house to confront the children.

However, witnesses claim that the man entered a residence on Oakley without permission and allegedly attacked the two minors. He allegedly threw several items at them and tossed one boy to the ground. When he chased the boys from the house, a neighbor reportedly tried to calm him down. The man then allegedly attempted to hit the neighbor.

The man was apprehended based on witness accounts. He was treated at St. Joseph's Wayne Hospital and charged with assault, criminal mischief and burglary. He posted $35,000 bail and was released.

A conviction on assault charges could result in long-term consequences such as jail time and a permanent criminal record. However, eyewitness testimony is not always a reliable form of evidence, and a defendant may wish to enlist the help of an attorney. A lawyer could dispute witness claims and mount a strong defense against the allegations.
