2 men taken into custody in New Jersey

Police say that they took two men into custody on Feb. 9 on heroin possession charges in Wayne. Both men were released on summonses. However, reports did not say when the men would next appear in court.

While police were handling that case, a 29-year-old man reportedly crashed his Mazda into another vehicle near the gas station. The man was asked to perform field sobriety tests after the crash, and officers suggested that he was under the influence of narcotics as well. Police charged the man with a narcotics DUI and being in possession of narcotics. The driver's girlfriend was in the car with him at the time of the accident, and she suffered facial injuries in the crash. She was treated for her injuries at St. Joseph's Wayne Hospital.

According to authorities, a 38-year-old man was seen walking into an Exxon bathroom on Route 23. When he came out, he was allegedly displaying behaviors consistent with someone under the influence of narcotics. After talking to the man, police came to believe that he was under the influence of heroin. He was charged with possession of drug paraphernalia, suspected possession of heroin and for being under the influence of heroin.

Those who are convicted on drug charges could face severe penalties. These sanctions could include prison time, a fine and probation in addition to time served in prison. A criminal defense attorney may be able to help someone charged with a crime avoid some or all of the penalties. For example, it may be possible to argue that the individual unknowingly took a controlled substance. Another defense strategy may be to cast doubt upon any report issued by the officer who took the defendant into custody if evidence suggests that the officer violated the defendant's rights during the arrest or investigation.
