Defenses for sexual assault charges

For New Jersey residents who are facing sexual assault charges, the consequences can be particularly severe. For example, a person who is convicted on these charges may potentially face a prison sentence, fines and may be required to register as a sex offender for a certain number of years. Depending on the circumstances, there are a number of defense strategies that could result in a dismissal of the charges or even reduce the severity of consequences.

In many sexual assault cases, there is often not a lot of evidence beyond the testimony of the accused person and the alleged victim. If the accused person can demonstrate that they were not at the location where the assault occurred, usually by providing an alibi, the charges may be dropped or the jury may return an acquittal. However, the person must be able to support their alibi with credible evidence.

Otherwise, the accused person may argue that the alleged victim consented to sexual activity. The accused person must show that the other person had a certain level of awareness in order to effectively use this defense. However, if age is an issue, arguing that the accused person was unaware of the person's age is not a defense.

Being accused of a sex offense can have an effect on a person's life for as long as they live. If there is any sort of evidence that demonstrates that the accused person was innocent or that the accuser consented to the activity, a criminal law attorney may have the ability to create a strong defense strategy for their client. In some cases, for example, the attorney may discredit the accuser during a trial or demonstrate how their client was either innocent or had consent.
