Traffic violations happen quite literally every day throughout New Jersey and although they may not seem like a very big deal, they can result in serious consequences. Traffic offenses can include red light violations, speeding tickets, cell phone violations, improper turns, reckless driving, and more. When you are issued a ticket for a traffic violation, you have a few options. You can either plead guilty and pay the ticket or fight the ticket in court with or without the help of an attorney.
What are Points?
If you choose to plead guilty and pay the ticket, you may be subject to points on your license and a fine that varies depending on the violation that was committed. When you get points on your license, your insurance premiums could rise and you may be subject to a license suspension if you already have too many points. If you choose the other option to go to court and fight the ticket, it is best that you do so with the help of an attorney. Your attorney will know the defenses available to you that can help you plead not guilty to the offense. If it is determined that you are guilty, your attorney can fight on your behalf for lessened penalties.
Excessive speed is one of the most common violations for which nearly everyone at some point in their driving career will be ticketed. In New Jersey, you can get points for the following speed limit violations:
- Careless driving can result in 2 points
- Speeding between 1 and 14 mph above the speed limit can result in 2 points
- Speeding between 15 and 30 mph above the speed limit can result in 4 points
- Speeding 30 mph or more above the speed limit can result in 5 points and a reckless driving ticket which is an additional 5 points
It is important to note that once you have acquired 6 points, you will face a surcharge until the points fall below 6. Once you have 12 or more points, you are subject to a license suspension.
